Terms of service

These are the terms you agree to by using CruisingSpeed. They are written to be read rather than to be impressive — if anything here is unclear, write to us and we will explain it in plainer words still.
1.Who we are
CruisingSpeed is operated from California, United States. You can reach us at team@cruisingspeed.app. “We” and “us” mean CruisingSpeed; “you” means the person or brokerage using it.
2.What the service does
You upload a boat’s material — photographs, video, spec sheets, surveys, service records, your own notes. We read it and build a listing package from it: verified specifications, sales copy, a chosen set of photographs, a short video, a branded launch report, and a page you can send a buyer.
Much of that reading and writing is done by automated tools, including large language models. That matters for clause 6, and it is the reason we ask you to check the work before you publish it.
3.Accounts and offices
An account belongs to an office. A single broker is an office of one. A brokerage has a roster: its admin invites colleagues, and everyone in the office can see the office’s listings and shares its branding. Each broker keeps their own name, title, phone number, email address and photograph, and those are what appear on their own work.
You are responsible for who you invite and for what happens under your account. Keep your sign-in details to yourself, and tell us if you think somebody else has them.
4.What you upload stays yours
You keep every right you had in the material you upload. You give us permission to store it and to process it for one purpose: building and delivering your packages. We do not sell it, we do not use it to advertise, and we do not use it to build anything for anybody else.
You must have the right to upload what you upload. Listing photography is very often licensed rather than owned — a photographer or a videographer usually keeps the copyright and grants the brokerage a licence to market the boat. Uploading material you do not have permission to use is not something we can check for you, and it stays your responsibility. If a rights holder contacts us about something in your account, we will tell you and may remove it.
5.What we make is yours to use
The packages we build for you — the copy, the report, the video, the buyer pages — are yours to use for marketing the boats they were made for. That does not end when your subscription does. A package you built while paying is a package you keep.
What ends is the making of new ones. See clause 8.
6.Check the work before you publish it
We read the documents you give us and pull specifications out of them. We are careful about it, we show you where each figure came from, and we flag it when two documents disagree. We do not guarantee that any of it is right.
A length overall, an engine hour count, a model year, a tank capacity, a price — these are representations you are making to a buyer, and in most places you are legally responsible for them. Read them before you publish. The same goes for the sales copy: it is a draft written from your own documents, and it is yours to correct.
We are not brokers, surveyors, or lawyers, and nothing the service produces is a survey, a valuation, or advice.
7.Paying
- Subscriptions are monthly and charged in advance. The price you signed up at is the price until we tell you otherwise, and we will tell you before a renewal, not after.
- Card payments are handled by Stripe. We never see or store your card number.
- Some brokerages are invoiced instead, on whatever terms we agree in writing.
- You can cancel whenever you like, from the billing portal or by writing to us. Cancelling stops the next charge; it does not refund the month you are in, and you keep full use until that month ends.
- If a card fails, Stripe will retry it for around two weeks. Your account keeps working throughout, and we will tell you it is happening.
8.What happens when you stop paying
Your account becomes read-only. It does not disappear and neither does your work.
Everything you built stays exactly where it is and keeps working: the packages, the uploaded files, the video, the launch reports, the buyer pages, and any link you have already sent to a client. You can still open all of it and download all of it.
What stops is making new things — new listings, rebuilt copy, fresh video or reports. Pay again and it all starts working the same day.
9.Trials
A trial is by invitation. We build one real package from a real boat of yours so you can judge the actual thing rather than a demonstration. Trial samples and the files uploaded for them are deleted 14 days after they are built unless you claim the package into an account. Claiming it makes it yours and takes it off that clock.
10.Fair use of the service
Don’t use CruisingSpeed to:
- market a boat you have no authority to market, or misrepresent one you do
- upload material you have no right to use
- resell the service, or build packages on behalf of brokerages who are not paying for it
- attempt to break, overload, or get around the limits of the system
We may suspend an account that is doing any of these. Where we can, we will ask first.
11.Availability
We work hard to keep this running and we do not promise it always will be. There is no uptime guarantee. We depend on other services — hosting, storage, video rendering, payments, email — and any of them can have a bad day.
We will give you reasonable notice before deliberately taking something away, and we will not delete your packages without telling you.
12.Ending the agreement
You can stop at any time. We can end an account for a serious or repeated breach of clause 10, or if we stop offering the service — in which case we will give you notice and a way to take your work with you.
If you ask us to delete your account, we will delete it and the files in it. That cannot be undone, so download anything you want to keep first.
13.Liability
To the extent the law allows, our total liability to you for anything arising out of these terms is limited to what you paid us in the twelve months before the claim.
We are not liable for lost profits, lost sales, or lost business — including a boat that did not sell, a listing that was published with a wrong figure in it, or a buyer who was not reached.
Nothing here limits liability for anything that cannot lawfully be limited.
14.Changes
We may change these terms. If a change matters to you — price, what you are allowed to do, what happens to your work — we will email you before it takes effect, and you can cancel if you do not agree. Small corrections take effect when the date at the top changes.
15.Law
These terms are governed by the laws of the State of California, and the courts of California have jurisdiction over any dispute. If a court finds any part of this unenforceable, the rest of it stands.
